Psystar Must Stop Selling Cheap Apple Clones

Apple wins permanent injunction against Mac clone maker, Psystar and the ruling is the Mac clone manufacturer is no longer allowed to sell systems running Mac OS X.
Psystar is also barred from “intentionally inducing, aiding, assisting, abetting or encouraging any other person or entity to infringe Apple’s copyrighted Mac OS X software.”
Psystar, the Mac clone maker recently taken down by Apple has revealed their plan to sell 1.87 million machines in 2011.
From Psystar: Under its conservative projections, Psystar told investors it would sell 70,000 computers in 2009, 470,000 systems in 2010 and 1.45 million machines in 2011. The firm’s aggressive growth model, however, put those numbers at 130,000, 1.87 million and 12 million during 2009, 2010 and 2011, respectively.
Recently, U.S. District Court Judge William Alsup favoured Apple by ruling that the Florida Company Psystar violated Apple’s copyright as well as the Digital Millennium Copyright Act (DMCA) when it installed Apple’s operating system on Intel-based computers.
The rogue company file for bankruptcy indicating that Psystar is more than $259,000 in debt.
Last December, the Psystar latest justification of selling unauthorized Mac systems by claiming Apple does not hold any copyright for its Mac OS X operating system. Psystar has agreed to pay Apple $2.7 million in damages ($1,337,500 plus $1,337,500 lawyer fees) rather than continue to trial in federal court in Northern California. This will likely bring the company’s sale of Mac cloned computers to an end.

Psystar Spreads OS X Virtualization Technology

Psystar is not letting go after being in multiple lawsuits with Apple due to copyright infringement and software licensing charges. Now the company has announced a new OEM licensing program, designed to spread the company’s OS X virtualization software to other clone makers. The Darwin Universal Boot Loader is able to boot up Apple Snow Leopard on any Intel machines.
Psystar will go on trial in January 10th, 2010.

Psystar Throws Copyright Abuse At Steve Job’s Face

In the latest effort for Psystar to be an Apple clone, they have ditched the antitrust lawsuit but instead attacked Apple with copyright abuse. Clone wannabe Psystar says Apple prevent competition via the End User License Agreement (EULA) and the Digital Millennium Copyright Act (DMCA). We do not see this going to dent Apple at all.

Apple And Psystar Agrees To Talk It Out Privately

Aple and Psystar has agreed to Alternative Dispute Resolution (ADR) where they will hold talks behind close doors.
Previously Apple has sued Psystar for making a clone of the Apple Macintosh which run modified versions of the Mac OS X Leopard. Then Psystar icountersued Apple for violating two federal antitrust laws, the Sherman Antitrust Act and the Clayton Antitrust Act. Psystar says that its OpenComputer product is shipped with a fully licensed copy of Mac OS X using open source technology.
Apple said, “by misappropriating Apple’s proprietary software and intellectual property for its own use, Psystar’s actions harm consumers by selling to them a poor product that is advertised and promoted in a manner that falsely and unfairly implies an affiliation with Apple.”
Mac Cloner Psystar Countersues Apple

Recently Apple has sued Psystar for making a clone of the Apple Macintosh which run modified versions of the Mac OS X Leopard. Now Psystar is countersues Apple for violating two federal antitrust laws, the Sherman Antitrust Act and the Clayton Antitrust Act. Psystar says that its OpenComputer product is shipped with a fully licensed copy of Mac OS X using open source technology.
Apple said, “by misappropriating Apple’s proprietary software and intellectual property for its own use, Psystar’s actions harm consumers by selling to them a poor product that is advertised and promoted in a manner that falsely and unfairly implies an affiliation with Apple.”
Apple is also asking for a recall of Psystar machines and also asking the court to recover unspecified damages.
